Foreclosure Bill May Harm Florida Homeowners

By Law Office of Maria L. Rubio  Mar. 6, 2012 10:35a

The state senate recently cleared a new bill (SB 1980) which would significantly speed up the foreclosure process for Florida mortgages in default. The bill has homeowners that are already worried about their current foreclosure or mortgage problems bracing for another hit. Proponents of the bill say that the purpose is to more expeditiously clear the way for the nearly 370,000 backlogged foreclosures in the state courts. According to a recent survey, nearly a quarter of the U.S.’s total foreclosures come from Florida. Are you facing foreclosure of your home? A Miami-Dade commercial litigation lawyer skilled in foreclosure defense may be able to help.

Bill Doesn’t Address Real Cause of Foreclosure Issue

Consumer protection agencies, state attorney general’s offices and others have indicated that the new foreclosure bill does not fix the real problem behind the onslaught of foreclosure cases and will only further harm those going through the process. Authorities have discovered cases where incorrect and flat out fraudulent foreclosure filings were brought against local homeowners. Critics are concerned that those who have been the victims of bank lending abuse and other mortgage and foreclosure difficulties will only be further victimized by the process if the bill becomes law. It is argued that if banks, lenders and other agencies involved in the mortgage process had their paperwork and documents corrected, validated and properly maintained there may not be as many foreclosure cases stalled in court as there apparently are.
